Contract Terms and Conditions for Boulder Bengals Kitten or Cat Purchase

Dear Buyer,
We wouldn't be looking at a contract if we didn't think you were responsible, kind, and would provide a wonderful home for one of our cats. This contract is an expression of your commitment to care for one of the animals we love, in conditions and the quality of life they deserve. If you agree to these terms, then you are on the way to owning one of our beautiful cats.

This contract applies only to the Buyer and Seller

The Bottom Line:

If at any time you are determined to be in breach of any of the terms and conditions stated herein, Boulder Bengals/Debra Winters reserves the legal right to remove the animal from the premises and the buyer will surrender the cat/kitten alive, any and all progeny alive together with appropriate papers to Boulder Bengals unconditionally and without compensation or refund and pay Boulder Bengals a non-punitive sum of five thousand dollars ($5,000) to defray costs of material, time and talent involved in the recovery. (Boulder Bengals may waive the $5,000 fee if the cat and any/all kittens are surrendered peacefully and without incident.)

NOTE: This agreement is intended to accompany the Buyers Responsibilities outlined in the Boulder Bengals Health Guarantee. Both documents must be signed to effect a valid sale.

The transaction represented by this contract is between Debra Winters, Boulder Bengals, Colorado, as seller, and the designated purchaser/buyer. The terms, conditions, and responsibilities of any and all parties cannot be transferred to any other party. The contract is executed in Boulder County, Colorado and is subject to the laws of the State of Colorado where any and all enforcement actions of this agreement shall be executed.

Summary of Buyers Responsibility as detailed in the Boulder Bengals Health Guarantee:

  • Isolate the kitten for a period not less than 14 days.
  • The new kitten must be isolated from other pets, especially other cats, for not less than 14 days.
  • Have the kitten examined by a certified veterinarian within 72 hours of the kitten arriving at Buyers home.
  • Our kittens are guaranteed to be of sound health, at the time of sale, and for a period of 72 hours.
  • Our kittens are guaranteed against any congenital defects until the kitten is one year of age.
  • Should the kitten die or become ill during the first year as a result of a congenital defect, the kitten will be replaced with another of equal value as soon as possible.

The Buyer Agrees to:

  • Provide regular health examinations and vaccinations for the kitten/cat on a schedule determined to be proper by a certified veterinarian.
    You will be provided a medical record for the kitten along with other paperwork. Be sure to review the medical record with your veterinarian and get a recommendation for follow-up and regular well-cat exams as preventative care and early diagnosis of illness.
  • Maintain the kitten as an indoor-only pet...
    ...and not allow the kitten outside unless on a leash or contained within a secure, fenced area designed and constructed to ensure the kitten's safety and health, and that prevents escape and disallows other wild or neighborhood animals from entry, and prevents access to roads and cars.   • BUYER AGREES TO NEVER HAVE A BOULDER BENGAL KITTEN OR CAT DE-CLAWED
    Declawing is an elective surgical procedure that is without benefit to the cat. Declawing is an irreversible surgical procedure performed by a veterinarian while the cat is under general anesthesia. Hospitalization for 1-2 days may be required. As the back feet are rarely used for scratching, the front feet are usually the only ones declawed. A cat's toe has three bones; the claw grows from the end of the last bone. In declawing, the veterinarian amputates the end section of the last bone, along with the claw. This removes the claw and prevents it from growing back. The toe is then sewn shut with absorbable sutures or closed with surgical skin glue, and each paw is bandaged snugly to control bleeding. Reference: The Dangers of Declawing Cats
    This provision is strictly enforced and will result in confiscation of the animal. Contact us for some kind alternatives for cat scratching behavior problems.
  • Provide immediate medical care if the cat/kitten shows signs of illness or distress in between well-cat exams.

Boulder Bengals places kittens/cats in wonderful homes, but unforseen, uncontrollable circumstances happen in life. If you are unable to keep your Boulder Bengals, kitten or cat:

  • If, within the first 30 days (or one year if the kitten has not been spayed/neutered), the kitten needs to be returned
    for other than kitten related health problems (as stated in the Health Guarantee), including but not restricted to any human allergies or pet conflicts, upon successful sale of the cat or kitten the owner will be given the proceeds of the sale, minus any reasonable expenses. Note that the interest of the cat will come first, even if the price needs to be reduced. (The kitten cannot be returned after the first 72 hours if it has been exposed to other animals that have not been currently vaccinated for FeLV and FIV.)
  • After 30 days or the pet is spayed/neutered and needs to be re-homed, it is required that the you contact Boulder Bengals for assistance in, and approval of, the relocation (or return to Boulder Bengals with no refund). No relocation may occur without the expressed, written consent of Boulder Bengals.

    Please note the following restrictions:

    Never sell, lease, lend, give, or abandon the kitten to a shelter, pound, pet store, animal humane organization, veterinarian, researcher organization, or any similar organization, institution, or person. Upon successful re-selling of the cat or kitten by Boulder Bengals, the owner will be given the proceeds of the sale minus any reasonable expenses. Note that the interest of the cat will come first, even if the price needs to be reduced.

For Pet Quality Kitty Purchases Only:

This kitten was sold for the sole purpose of being a pet/companion for the buyer and must NEVER be allowed to produce offspring. The kitten must be altered (spayed/neutered) by a qualified veterinarian before the kitten reaches the age of 5 months, and before Boulder Bengals will provide TICA pedigree registration papers! Failure to spay/neuter your pet before the age of 5 months will require that the buyer then pay Boulder Bengals a balance of $1,000 for breeder rights before the kitten is six months old.

Seller must receive proof of alteration from the veterinarian that performs the service on or before ____________________ or buyer will be in breach of contract.
